These Terms of Use (“Terms”) govern access to and use of the website and services of WhatsCornGonnaDo.com (“Company,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, you must not use the Site.
1. Nature of Services
The Site provides impersonal, automated market commentary, educational content, and related materials. Content is generated electronically and may incorporate third-party data and analytical models. The Site does not provide financial, investment, legal, or tax advice, and no fiduciary or advisory relationship is created.
2. Eligibility
The Services are available only to individuals who are eighteen (18) years of age or older. By using the Site, you represent that you meet this requirement.
3. Subscriptions and Payments
- Subscriptions are billed on a recurring monthly basis through Stripe.
- You may subscribe to one or more commodities, futures, or market categories. Each subscription has its own billing cycle beginning on the date of enrollment.
- Fees are quoted on a monthly basis and automatically renew until cancelled.
- Cancellations may be made at any time, but access will continue until the end of the current billing cycle. No pro-rated refunds will be issued.
- We reserve the right to modify subscription fees prospectively with reasonable notice.
Subscriber Use Only / No Redistribution. Subscriptions are personal to the subscriber. Reports, commentary, and other content delivered through a subscription are intended solely for the subscriber’s own use. They may not be shared, distributed, displayed, transmitted, or otherwise made available to any other person or entity, whether inside or outside the subscriber’s organization, without our prior written consent. Any attempt to circumvent this restriction constitutes a material breach of these Terms.
4. Intellectual Property
All content, reports, data, graphics, and software made available on the Site are the property of WhatsCornGonnaDo.com or its licensors. All rights are reserved. Nothing shall be construed as conferring on any subscriber or third party any license or right by implication, estoppel, or otherwise, under any intellectual property law.
Unauthorized use, copying, modification, reproduction, republication, distribution, or creation of derivative works is prohibited. Any unauthorized use may result in termination of access without refund and may subject the subscriber to legal action.
5. Restrictions on Use
Subscribers may not use the Site or its content to transmit false, misleading, fraudulent, or unlawful communications, or to interfere with the operation of the Site.
6. Third-Party Data and Tools
Content may incorporate or rely on information from third-party suppliers and services. We do not control those sources and disclaim responsibility for their accuracy, timeliness, or completeness.
7. Disclaimers
The Site and its content are provided for informational purposes only and without warranties of any kind, whether express or implied. No assurance is given as to accuracy, adequacy, timeliness, or completeness. Past performance is not indicative of future results. The risk of loss in trading futures and options can be substantial. You must conduct independent analysis before making decisions.
8. Limitation of Liability
To the fullest extent permitted by law, WhatsCornGonnaDo.com disclaims all liability for damages, losses, or claims arising from reliance on or use of the Site or its content, including third-party content. In no event shall total liability exceed the greater of one hundred dollars ($100) or the total subscription fees paid by you in the three (3) months preceding the claim.
9. Indemnification
Subscribers agree to indemnify and hold harmless WhatsCornGonnaDo.com, its affiliates, officers, and employees from any claims, damages, or expenses arising from misuse of the Site or violation of these Terms.
10. Termination
We may suspend or terminate access to the Services at any time, without refund, if you breach these Terms, including but not limited to:
- unauthorized sharing or redistribution of content;
- infringement of intellectual property rights;
- non-payment; or
- other unlawful or prohibited use.
Provisions concerning Intellectual Property, Unauthorized Use, Disclaimers, Limitation of Liability, and Governing Law survive termination.
11. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Delaware, without regard to conflicts of law principles. Disputes shall be resolved through binding arbitration administered by the American Arbitration Association on an individual basis. Class actions and jury trials are waived.
12. Modifications
We may revise these Terms at any time. The effective date above reflects the latest version. Continued use of the Site constitutes acceptance.
